L'escussione del **[Performance Bond](https://www.bdalaw.it/it/il-performance-bond)** non fa eccezione. Ma come si può concretamente escutere un Performance Bond?   Dipende molto da come è scritto un performance bond. Ma esistono anche performance bond nella forma di garanzia autonoma ma con **clausola a richiesta documentata** o con **clausola a richiesta giustificata**.   ## 1. Clausola a prima richiesta Il performance bond con *clausola a prima richiesta* è senz'altro la più diffusa ma anche quella che consente il maggior vantaggio al beneficiario perché può essere escussa proprio sulla base di una semplice richiesta inviata alla banca. Nessuna particolare formalità, nessuna particolare terminologia (salvo che il testo della garanzia preveda diversamente).  Basterà ad esempio inviare una richiesta alla banca dal seguente tenore: *"We hereby demand payment of the performance bond no. ___ issued by your Bank with reference to contact no. ___within 5 days from the receipt of this request"*   ## 2. Clausola a richiesta documentata   In questo caso, il performance bond rimane una garanzia autonoma ma non è più a semplice richiesta nel senso che la richiesta dovrà essere accompagnata da ulteriori documenti.  Tipico il caso in cui l'escussione debba essere accompagnata dalla dichiarazione o certificazione di un soggetto terzo e indipendente che dichiari la mancata consegna della merce o la mancata esecuzione di opere oggetto del contratto di appalto. L'escussione potrà avere, in questa ipotesi, il seguente tenore:   *"We hereby demand payment of the performance bond no. ___ issued by your Bank with reference to contact no. ___within 5 days from the receipt of this request.* *As provided under the performance bond, we attach the declaration of Mr. ______ who ascertained on ____ the failure of the plant to reach the guaranteed performance"*   ## 3. Clausola a richiesta giustificata   In tale ipotesi, la lettera di escussione dovrà contenere un'indicazione abbastanza dettagliata degli inadempimenti che giustificano la richiesta di escussione. Se, ad esempio, il contratto principale prevede che il bond possa essere escusso solo quando più del 10% della merce consegnata risulti difettosa, allora tale circostanza dovrà essere specificata nella lettera di escussione.
